The Surveillance Stack: Where the Power Was Built

The newest surveillance tool is rarely the beginning of the story. Its power rests on an accumulated infrastructure of data, systems, and traces that was built long before the latest technology came into public view.


We need to talk about the surveillance stack. Not the latest tool to burst into public view. “Facial recognition.” “Flock.” “Axon’s Draft One.” And not the narrow question of whether government should be allowed to use that particular tool of the moment. That conversation is not enough. Because the tool is not the whole threat. The deeper power comes from the surveillance stack underneath it: the accumulated layers of images, location trails, communications, police files, forensic data, and other digital traces collected and shared across public and private systems.


Borrowing from the language of information technology, the term "stack" does not refer to a single system. It is, instead, the accumulated technical and data infrastructure (including hardware, software, and collected data) that allows information gathered in one place or for one purpose to become available to another tool, platform, investigation, or institution.


The public sees the false match notification or the creepy Super Bowl ad. But the power was built earlier, when public and private entities began making the “privacies of life” available for computational analysis. Without that accumulated stockpile of data, there is no facial recognition search. No license plate reader network. No AI system to train, prompt, query, or trust.


We have imagined this future for a long time, whether as a theory of control or as a dystopian warning: the panopticon or Big Brother. What is different now is that the underlying data systems have been built into the ordinary infrastructure of public and private life.


The threat is not only that a particular tool may be inaccurate, biased, or invasive. It is that each new tool can draw power from a surveillance stack that was already built before the public knew what to call it. A system that can reach across existing stores of images, location data, communications, records, and other traces is more powerful because those stores already exist.


Nor does the stack fall evenly. Its most controlling layers are built around the people and communities already most exposed to policing, prosecution, poverty regulation, family separation, immigration enforcement, and public control. Those systems generate records of their own: encounters, photographs, addresses, family relationships, movements, financial information, and more. The people most subject to state attention therefore become the people about whom the state has the most data, making them increasingly visible to the next system layered on top. [1]


Seen this way, the latest tool is not the right place to begin our collective conversation.


We need to stop waiting for the next tool to break into public view, and instead start asking:


What data is making these tools possible?


Who collected it?


Who controls it now?


Who can access, use, and inspect it?


What else is it linked to?


Who can restrict access to it, challenge its use, or require that it be deleted?


These are not abstract technology questions. They are litigation questions, policy questions, civic design questions, and democratic questions. They emerge in criminal cases, procurement decisions, and the daily lives of people most exposed to state control. And they cannot be answered if the stack remains invisible.


That is the work ahead: surfacing the surveillance stack, making it understandable, and forcing it into democratic contest in our courthouses, in our legislatures, and in our public meeting spaces. We cannot leave these questions to Big Tech and executive agencies. Their answers belong to us.
